Approach
Shoki adopts a commercially informed, pragmatic and human-centred approach to mediation, recognising that disputes are seldom about legal rights alone. Drawing on her litigation experience, including personal injury matters ranging from medical malpractice and professional negligence to product liability, she understands the evidentiary, liability, quantum and risk considerations that influence settlement. Her approach is flexible and may incorporate evaluative, transformative and narrative techniques, depending on the nature of the dispute and the needs of the parties. Through active listening, strategic questioning and appropriate reality-testing, she assists parties to move beyond entrenched positions, identify their underlying interests and assess the risks and costs of continued litigation. Her focus is on creating a balanced and constructive process that enables parties to make informed decisions and achieve practical, commercially viable and durable resolutions.
