1. Ensure that the parties understand the process, the potential outcome and feel comfortable in the mediation. 2. Allow the parties to speak freely and without limits or interruptions - as far as possible. 3. Earn the trust of the parties. 4. Listen carefully and clarify points that are made. Ensure that the parties hear one another. 5. Identify the issues that could prevent settlement as soon as possible. 6. Encourage the parties to focus on their interest and not only on their legal position. 6. Eliminate the resistance to a settlement by applying suitable strategies.
